ARTICLE 2 - SUBJECT
The subject of this Agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product/products, the characteristics and sales price of which are specified below, ordered electronically by the BUYER from the SELLER's website www.eartgaleri.com.
ARTICLE 3 - CONTRACT PRODUCT, PRICE AND PAYMENT INFORMATION
3.1. The type, quantity, brand/model, color, number of units, sales price, and payment method of the Goods/Product/Service consist of the information at the moment the order is completed.

3.2. Since installment sales are made only with credit cards belonging to Banks, the BUYER accepts, declares, and undertakes that they will confirm the relevant interest rates and default interest information separately from their bank, and that the provisions regarding interest and default interest will be applied within the scope of the Credit Card Agreement between the Bank and the BUYER in accordance with the legislation in force.
ARTICLE 4 - DELIVERY AND PERFORMANCE METHOD
4.1. The product subject to the agreement shall be delivered to the BUYER or to the person/organization at the address indicated by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal 30-day period.
4.2. If the product subject to the agreement is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person to be delivered is not present at the address or does not accept delivery.
4.3. The SELLER is responsible for delivering the product subject to the agreement intact, complete, in accordance with the qualifications specified in the order, and together with warranty documents, certificates, and user manuals, if any.
4.4. At the time of delivery of the product, physical inspection by the BUYER or the receiving person is essential. If crushing, tearing, opening of the shipping package, or damage to the product is detected, a "Damage Assessment Report" must be prepared by the courier officer and the product must not be accepted.
ARTICLE 5 - RIGHT OF WITHDRAWAL
5.1. In distance contracts regarding the sale of goods, the BUYER has the right to withdraw from the contract by rejecting the goods within 14 (fourteen) days from the date of delivery of the product to themselves or to the person/organization at the address indicated, without assuming any legal or penal liability and without stating any justification.
5.2. In order to exercise the right of withdrawal, notification must be made to the SELLER within the 14 (fourteen)-day period. This notification can be made via email (info@eartgaleri.com) or in writing to the SELLER's address.
5.3. In case the right of withdrawal is exercised:
- A copy of the courier delivery report indicating that the product delivered to the BUYER or a 3rd party has been sent to the SELLER, along with the invoices (E-invoice/E-archive), must be delivered to the SELLER.
- Within 14 (fourteen) days following the receipt of the withdrawal notification by the SELLER, the product price shall be refunded to the BUYER through the payment method used.
- The BUYER must return the goods to the SELLER within 10 (ten) days from the date the right of withdrawal is exercised, via the SELLER's contracted shipping company [Contracted Shipping Company Name]. If the return is made with the shipping company specified by the SELLER, the shipping cost belongs to the SELLER.
ARTICLE 6 - CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED (EXCEPTIONS)
Pursuant to Article 15 of the Regulation on Distance Contracts, unless otherwise agreed by the parties, the BUYER cannot exercise the right of withdrawal in the following contracts:
- a) Contracts concerning goods prepared in accordance with the consumer's requests or personal needs (e.g., artworks and products personalized, custom-framed, or specifically produced for the BUYER upon special request).
- b) Contracts concerning the delivery of goods whose protective elements such as packaging, tape, seal, or box have been opened after delivery, and whose return is not suitable for health and hygiene reasons.
- c) Contracts concerning books, digital content, and computer consumables presented in physical media, if their protective elements such as packaging, tape, seal, or box have been opened after delivery.
ARTICLE 7 - DEBTOR'S DEFAULT AND FORCE MAJEURE
7.1. In the event that one of the parties fails to perform its obligation, the provisions of the Turkish Code of Obligations regarding the debtor's default shall apply.
7.2. If the SELLER cannot deliver the product subject to the agreement within the specified period due to force majeure or extraordinary circumstances preventing transportation (earthquake, flood, fire, epidemic, transportation disruption, etc.), the SELLER is obligated to notify the BUYER. In this case, the BUYER may exercise one of the rights to cancel the order or to postpone the delivery time until the preventing situation disappears. If the BUYER cancels the order, the amount paid shall be refunded within 14 (fourteen) days.
ARTICLE 8 - JURISDICTION AND RESOLUTION OF DISPUTES
In disputes arising from the implementation of this Agreement, Consumer Arbitration Committees and Consumer Courts located in the place where the BUYER purchased the goods or services or where their residence is located are authorized, within the monetary limits declared annually by the Ministry of Trade.
This agreement has been read, accepted, and approved electronically by the BUYER.
